Joint Tenancy

Standard Definition

A form of co-ownership characterized by the right of survivorship and the four unities: Time, Title, Interest, and Possession (PITT).

Detailed Examination Analysis

Joint Tenancy is a form of co-ownership for two or more people. The defining feature is the right of survivorship: if one joint tenant dies, their share automatically passes to the remaining joint tenants, bypassing probate and any will. To establish a joint tenancy, the owners must acquire the property at the same time, through the same deed, with equal shares and equal rights of possession.

Real-World Examination Scenario

"Two business partners purchase a property as joint tenants. If one partner passes away, the surviving partner automatically becomes the sole owner of the property."
